The most ridiculous thing happened to me yesterday:
Friday afternoon I walk into the Beer Store to buy some cold ones. I pay at the cash and then as I'm walking towards the door I get slammed in the back of the head with what feels like a baseball bat. I fall to me knees and get up 'cos I'm thinking maybe someone's sucker punched me. The girl on the cash is screaming at a guy on the other side of the store.
Turns out an employee has thrown a new roll of thermal printer paper (big sucker) to his buddy on cash at the other end of the store and it ends up hitting me square in the base of my skull.
I get all the details and witness names/signatures and drive myself to Emergency. X-Rays show no broken bones, but bruising and muscle damage.
Anyways, I'm sat here in pain with my neckbrace on wondering whether I should call a lawyer on Monday.

I wouldn't waste your time unless you have loss of wages or doc bills over 5K american.
I don't know if you guys have small claims court there but here if you want to take someone ( business or otherwise) to court for small amounts of fees you can easily do it yourself with a witness and doctor bills, pictures, etc.

Sorry, but this won't be a small claim. He could get at least 50K from this, just from the stores insurance. That's before the lawsuit.

This is the kind of situation where you can sue and almost asuredly win, but you have to ask yourself whether or not "you're that guy?".
As someone else said if you aren't missing work or getting stuck with a huge hospital bill then I wouldn't worry about it. As bad of a night you had it was all just an accident. Even if it was an accident caused by carelessness and stupidity. I'm betting that as soon as that bump on your head goes away you'll be able to laugh about it and not that long after you'll stop thinking about it unless someone reminds you.

What I'm saying is that if you aren't seriously hurt then he has nothing to (legitimately) claim.
Unless you can afford a lawyer that can sling a bunch of bullshit and totally lie your way into tons of money..
p.s. I would have certainly informed the manager of the store if anything. But know that if the store gets sued (assuming that its a major conglomerate) all of the workers will pay for it dearly.

Like YAK and EYEZ say, be reasonable about it. If you loose wages or have any lasting damage, sue 'em. Sure, the insurance pays, but that young fella will be looking for a new job... If there was no lasting harm and you're back at work on Monday, maybe suggest some liquid compensation instead of litigation...

nah man heres what u need to do.... u go and buy an even bigger box of printer paper, go bk into the store and launch it at the employees face as hard as you can ( take run up if need be) assuming the guy goes to floor, stand over him and say to him 'how do u like them apples' wins everytime. and u will feel much better for it aswell lol

You can also negotiate with the stores ins directly without getting a lawyer. Tell the insurance rep that contacts you that you would rather not make such a big deal about it and hire an attorney so if they would settle with you for a reasonable amount (dr's visits, tests, inconvience of going to these things) you will waive your right to sue. The reps at ins co's can settle with you if you are reasonable. They would rather give you a check for $2000 and have you go away then fight you in court.

I say sue. So what if the guy looses his job, if he had the respect to behave while customers are in the shop then the situation wouldn't exist. He'll probably loose his job soon anyway regardless of whether you sue or nor, I wouldn't be happy employing staff that prove to be a liability to my customers and throw my stock around the shop.

People have been watching WAY too much tv.
Unless you have actual medical costs, loss of work etc do not pursue it. If you do then keep track of everything ie. medical visits, mileage, missed work, medications, prescription deductible etc... Keep a journal of sorts of how you feel everyday, things you want to do but can't, things relatives friends now have to do for you and the such.
If you do pursue a case know that the store will be requesting all of your medical records and on top of that you'll have to see an independent doctor that will determine how injured you 'really' are.
Lawsuits are SLOW, don't expect anything for at least a year or two. Criminal cases get priority then civil cases based on how long they've been in the system. If you are looking for quick money... move on.
Regardless of all this do call the manager of the store and let him know what happened.

I spoke to the manager just before I went to the hospital - he filled out an accident report that states "cashier threw a roll of thermal paper across the store to another cashier, it missed and struck the customer on the back of his neck as he was leaving the store" - I have 2 signed witnesses and it's caught on tape.
Part of me says "let it go" part of me says only a complete loser would not pursue something like this.
It's not like the case in the U.S. where the woman sued for a couple million because her McDonald coffee was too hot - I was poleaxed from behind by a store employee whilst going about my business - and they have admitted liability (read gross negligence) on paper.
Mind you - the "free beer for life" does sound appealing............

That sounds like "legitimate" injury to me... so why would a lawyer have to sling a bunch of "bullshit" in order to help him get compensated for his injury?
And I was wondering.. you seem worried about the workers paying dearly for it IF he sues... but didn't you recieve a pretty large settlement last year.. and were those your concerns then as well?

The store employed a retard, the retard injured a member of the public could have been another member of staff, the store is probably in breach of health & safety regs, I doubt if throwing rolls of thermal paper about is considered safe, the manager should be sacking the retard anyway.
